GOA: TWO KIDS SUE CCP FOR ENCROACHING THEIR PARK IN PANAJI

Panaji (Goa) Two Panaji resident children have approached Bombay High Court at Goa to prosecute the local civic body of a contempt after it failed to action the illegal kiosks in the children park.

Petitioners Advait Mudras, 11, and Deona Pereira, 08, have filed Public Interest Litigation (PIL) before the high court claiming that Corporation of City of Panaji can be sued for contempt of court for violating the order.

The High court through its order in the year 2008 had directed that “if any gaddas/handcarts are encroaching on the public roads, streets or footpaths, the corporation has to act in accordance with the law and take action within three months.”

Several kiosks in the State were removed after the High Court order, resulting in the footpaths being kept free for pedestrians.

The court had then also ordered that the civic bodies should form enforcement squad which will clear all the footpaths, within the city limits from all encroachments including unauthorized hawkers, squatters or repairers and other persons.

Both the children in their petition has pleaded that the contempt be moved against CCP for contempt of court. CCP commissioner and IAS officer Ajit Roy has been made respondent in the petition.

The petition claims that “till date, the enforcement squad has not conducted patrolling in the city regularly. Moreover, no action is being taken after receiving complaint from the residents about the encroachment, thereby contravening the High Court order.”
