Rodrigues has today served a legal notice on the Chief Secretary over the blatantly illegal, arbitrary and very high-handed decision of the Goa Government to appoint Nadkarni on retainership to appear for the State before the Supreme Court, National Green Tribunal, High Courts and other Tribunals on a monthly retainership of Rs 7.5 lakhs and Rs 3 lakhs per hearing with four free flights a month to Goa.
He stated that Nadkarni could not be appointed on retainership as it would be incongruous to allow a Law Officer already as retainer of the Union of India for Rs 50,000 a month and Rs 20,000 per hearing to be a retainer for any other entity, including the State Government.
Giving the Goa Government 48 hours to revoke the decision, Adv Rodrigues has in his notice stated that he would otherwise be constrained in public interest to move the Bombay High Court at Goa for appropriate orders.
In his notice he further stated that ‘decision of the cabinet besides being patently illegal and unlawful seems to be a very devious way by a cash-strapped Goa Government of pompously extending Nadkarni through the backdoor the role and benefits of Advocate General for whom its now have the cake and eat it too.’
He has also alleged that decision of the cabinet was a sheer act of misgovernance and nepotism.
