Panaji (Goa) After nearly six years of investigation and subsequent trial, former teacher of Progress High School has been sent to jail for molesting a student with Children’s Court sentencing him to four years of rigorous imprisonment.
During the case trial, the Children’s Court last year discharged him from charges of rape but continued the trial in other offenses. He was convicted in an order earlier this month. When the matter came up for quantum of sentence today, the court sentenced him to four years of jail for molestation (section 354 IPC) and three years on charges under section 8 (2) of the Goa Children’s Act. The Court has also slapped fine of Rs 1.50 lakh,
Kanhaiya Naik, a drawing teacher was charged with molesting 14-year-old student at his flat in Ribandar on December 29, 2011. The incident had come to light two days later after the girl’s mother noticed marks on her daughter’s neck. Then aged 45 years, Naik was arrested in January 2012 on charges of rape, molestation and other relevant sections of the Indian Penal Code and Goa Children’s Act. The girl was sent to his residence for career guidance when he committed the offense. He was released on bail soon thereafter prompting the girl to commit suicide. In her dying declaration, the girl – who had burnt herself – told the magistrate that she took the extreme step fearing for her life as the accused was on bail. A separate offense for abetment to suicide was thereafter registered against him followed by his arrest and bail. The government had dismissed him from the job.
