Adv. Aires Rodrigues has today filed a complaint with the Director of Archaeological Survey of India (ASI) at Old Goa over the alleged illegal massive palacial bungalow built by Power Minister Pandurang Madkaikar at Old Goa.  A copy of the complaint has been sent to Prime Minister Narendra Modi and Goa Governor Mridula Sinha.

In his complaint Adv. Rodrigues has stated that in total violation of law a very huge palacial bungalow has been built in survey No 144/1 and 144/2 by Pandurang Madkaikar through his company Nikitasha Realtors Pvt Ltd within the prohibited 300 mts from the Central Protected Monument Basilica of Bom Jesus Church at Old Goa with the compound wall of the bungalow being less than 50 mts from the protected Monument.

Adv. Rodrigues has in the complaint drawn the attention that on 13th June 2011 Mr. Pandurang Madkaikar in reply to the show cause notice issued by the Archaeological Survey of India had given a written undertaking to dismantle within three months the fencing which falls within 100 mts of the protected monument.

Adv. Rodrigues has also pointed out that Archaeological Survey of India by a notice issued on 3rd November 2015 had directed Pandurang Madkaikar to stop construction activity within the prohibited 300 mts from the centrally protected Monument but that Pandurang Madkaikar chose to ignore the notice while the Archaeological Survey of India did not take any coercive action to uphold the law.

Adv. Rodrigues has further stated that the Archaeological Survey of India by a letter dated 3rd November 2015 had also directed the Old Goa Police Inspector to register an F.I.R against Pandurang Madkaikar over the unauthorized compound wall but that the Archaeological Survey of India did not pursue the matter though the violation was so blatant.

Adv. Rodrigues in his complaint has called upon the Archaeological Survey of India to conduct an immediate inspection of the illegal construction by Pandurang Madkaikar’s Nikitasha Realtors Pvt Ltd and to order the immediate demolition of the structure which is in violation of law.

While stating that  such a glaring violation cannot be allowed just because it has been committed by the very influential Power Minister, Adv. Rodrigues  has stated that if no action in this serious violation of law is taken within seven days that he  would be constrained to move the Court for appropriate orders to ensure that the law is enforced.
